Terms of Service

These Terms of Service ("Terms") govern your use of the VibrantEye mobile application and related services (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

VibrantEye is a daily color-hunting game. Each day the app publishes a target color; you photograph real-world objects, and the app scores how closely the captured color matches the target. Scores feed daily leaderboards, a personal color catalog, and a Hall of Fame.

2. Eligibility and accounts

• You must be at least 13 years old (or the minimum age of digital consent in your country) to use the Service.
• You can sign in with Google or Apple. You are responsible for keeping your sign-in credentials secure and for all activity under your account.
• You must provide accurate information and may not impersonate another person or use a display name that is offensive or misleading.

3. Your content

Photos you capture in the app are used to score your color match and, where the game requires it (for example leaderboard thumbnails or Hall of Fame entries), may be shown to other players alongside your display name and score. You keep ownership of your photos. By submitting a photo you grant us a non-exclusive, worldwide, royalty-free license to host, process, and display it solely to operate the Service.

You agree not to submit content that:

• is unlawful, hateful, sexually explicit, or harassing;
• violates another person's privacy or intellectual-property rights;
• contains other people's identifiable faces without their consent.

We may remove content that violates these Terms and suspend accounts that repeatedly do so.

4. Fair play

The game only works if the hunt is real. You agree not to cheat, including submitting screenshots or images of screens, digitally generated or edited images, tampering with the app or its network traffic, using automation, or exploiting bugs to influence scores or leaderboards. We may invalidate scores, remove leaderboard entries, or suspend accounts involved in cheating.

5. License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app on your devices for your own non-commercial use. You may not copy, modify, distribute, sell, reverse engineer, or create derivative works of the Service except where permitted by law.

6. Availability and changes

The Service is provided free of charge and depends on third-party infrastructure. We may modify, suspend, or discontinue any part of the Service (including daily challenges, leaderboards, or the catalog) at any time. We will make reasonable efforts to announce material changes in advance.

7. Termination

You may stop using the Service and delete your account at any time (see the Account Deletion page). We may suspend or terminate your account if you materially breach these Terms, if required by law, or if we discontinue the Service.

8. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including fitness for a particular purpose and non-infringement. Color scoring is automated and approximate; we do not guarantee any particular score, ranking, or availability of past data.

9. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, arising out of or relating to your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us to use it (which, for a free service, is zero) or the minimum amount required by applicable law.

10. Changes to these Terms

We may update these Terms from time to time. When we make material changes we will update the "Last updated" date above and, where appropriate, notify you in the app. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
